These Terms of Service (“Terms”) are a contract between you and [Company Legal Name] (“we,” “us,” or “our”) for use of FirstToShip at https://firsttoship.com (the “Service”). FirstToShip is a web-based guided course/kit to help you ship your first app. It is sold as a one-time digital purchase (currently priced at $99 USD unless otherwise stated). It is not distributed through the Apple App Store or Google Play and does not use in-app purchases (IAP).
By accessing or purchasing the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility (18+)
You must be at least 18 years old to purchase or use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to enter this agreement. The Service is not directed to children under 13.
2. The product
FirstToShip provides educational content, guidance, checklists, and related digital materials to help you plan and ship a first web app. Features may include progress tracking, unlockable content, and recommendations for third-party tools (e.g., Codex, Claude Code, Cursor, and optionally Base44).
We may update, improve, or discontinue parts of the Service. We do not guarantee specific outcomes (including that you will successfully ship an app, generate revenue, or achieve any particular result).
3. Account and access
You may need an email or account to access purchased content. You agree to:
- Provide accurate information
- Keep login credentials confidential
- Notify us promptly of unauthorized access
Access is for you personally (or a single seat under your purchase) unless we expressly offer team/multi-seat licenses. You may not share, resell, or publicly redistribute kit materials in a way that substitutes for purchasing the Service.
4. Purchases and billing
- Price and taxes (if any) are shown at checkout.
- Payment is processed by a third-party payment processor ([Payment Processor Name / TBD]).
- Digital goods are typically delivered immediately after successful payment (access/unlock).
- Currency and displayed pricing may vary by checkout configuration.
Refunds are governed by our separate Refund Policy. Chargebacks filed without contacting us first may result in suspension of access pending resolution.
5. License to use FirstToShip content
Subject to these Terms and your valid purchase, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use FirstToShip materials for your own learning and projects.
You may not:
- Copy, scrape, or redistribute the course materials for others’ commercial use
- Reverse engineer the Service except where law prohibits that restriction
- Remove branding, copyright, or proprietary notices
- Use the Service to build a competing course that substantially copies our structure and wording
- Circumvent paywalls, unlocks, or access controls
All rights not expressly granted are reserved by [Company Legal Name] and its licensors.
6. Your projects and IP
You own what you build. Apps, code, designs, and content you create while following FirstToShip remain yours (subject to third-party licenses for tools, libraries, and assets you use).
You grant us no ownership of your projects. If you voluntarily share feedback, testimonials, or suggestions with us, you grant us a royalty-free license to use that feedback to improve the Service (and testimonials only with your permission or as otherwise lawfully obtained).
7. Third-party tools disclaimer (important)
FirstToShip may recommend or link to third-party tools, including but not limited to:
- Codex
- Claude Code
- Cursor
- Base44 (optional Path B; may use an affiliate link — see Affiliate Disclosure)
These tools are independent products. We are not affiliated with Codex, Claude Code, or Cursor in a partnership sense for this listing, and we do not control their pricing, availability, terms, privacy practices, output quality, or downtime.
You are solely responsible for:
- Creating accounts with those providers
- Complying with their terms of use
- Any fees they charge
- What you paste into AI tools (including secrets and personal data)
- Security, deployment, and legal compliance of apps you ship
We are not liable for third-party tool failures, account bans, AI-generated mistakes, data leaks from tools you use, or damages arising from following third-party documentation.

8. Acceptable use
You agree not to:
- Violate law or others’ rights
- Attempt unauthorized access to our systems or other users’ accounts
- Abuse support, payment, or refund processes (including fraudulent chargebacks)
- Upload malware or disrupt the Service
- Harass staff or other users
- Misrepresent your identity or affiliation
We may suspend or terminate access for material violations.
9. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Following the course will produce a successful or profitable app
- Third-party tools will work as described
- Content is complete or current for every stack or jurisdiction
Educational content is general guidance, not professional legal, tax, security, or investment advice.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL.
- OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR FIRSTTOSHIP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $99.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.
11. Indemnity
You agree to defend and indemnify [Company Legal Name] and its owners, employees, and contractors against claims, damages, and expenses (including reasonable attorneys’ fees) arising from: your misuse of the Service; your apps or projects; your use of third-party tools; or your violation of these Terms or applicable law.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you also acknowledge that Policy.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) survive termination.
If we permanently discontinue the Service without cause, we will handle prepaid access fairly in line with our Refund Policy and applicable law.
14. Governing law and venue
These Terms are governed by the laws of [Governing Law / Venue], without regard to conflict-of-law rules. Courts located in [Governing Law / Venue] will have exclusive jurisdiction over disputes, except where consumer-protection law gives you a mandatory right to sue elsewhere, or where a small-claims court is available and appropriate.

Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and contact us about unused access where applicable.
16. Miscellaneous
- These Terms, plus the Privacy Policy, Refund Policy, Affiliate Disclosure, and Cookie Notice, are the entire agreement regarding the Service.
- If a provision is unenforceable, the rest remains in effect.
- Our failure to enforce a right is not a waiver.
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Domain covered: firsttoship.com only (and subdomains we operate for the Service).
